Terms & Conditions

Taxes & Duties:
GST @ 18% is applicable excluding the machinery cost and any changes in Government Taxes policies will be automatically applicable at the time of supply and the same as to be borne by the buyer

Payment Terms:
50% Advance has to be paid during order confirmation and remaining 50% has to be paid before dispatch.

Warranty:
Service warranty for the Period of 12 months from the date of supply or installation whichever is earlier and only against any manufacturing defects. WARRANTY shall not apply to defects resulting from improper operation, unauthorized service, improper work environment, unsuitable power supply and faulty installation. During the warranty period SRI LAKSHMI FOOD MACHINES has the authority to decide whether to repair or replace parts which proves to be defective. Warranty does not cover normal wear and tear.

Demonstration:
Demo at the Factory is free of cost. However the cost of food ingredients used for demonstration such as flour, oil, fuel etc. has to be borne by the buyer.

On-site Demo:
One technician will be provided for initial installation and demonstration at the discretion of our company for limited period. Buyers are liable to pay for food, transportation and accommodation expenses during the period of installation and demonstration.

Transportation:
Packing and shipping charges is excluding the machinery cost. Kindly note that the buyer is liable for any damages caused to machinery during transportation.

Technology:
SRI LAKSHMI FOOD MACHINES reserves the right to make design changes or introduce new technological advancement to the machineries from time to time. Buyer’s decision at the time of booking is final and any modification requested later will done at additional cost – if only possible.

Delivery Period:
Tentative delivery period is 30 Days from the date of receipt of 50 % Advance. Tentative delivery period is only estimated date and the seller is not liable for any loss incurred due to Non-Delivery. SRI LAKSHMI FOOD MACHINES reserves the right to withhold delivery of part or all of the Equipment.

***Tentative delivery date is not applicable for newly researched and developed machineries.

Risk:
SRI LAKSHMI FOOD MACHINES is not liable for personal injuries, Death, permanent total disability or permanent partial disability caused by operating the machinery without following the safety instructions. SRI LAKSHMI FOOD MACHINES is also not liable for damages caused to the machinery due to natural calamities, accidents, riots etc...

Cancellation and Return:
The buyer shall not be entitled to cancel any order once accepted without prior agreement of the seller, and on terms that protect the seller against loss. The seller will not accept the return of goods for credit or exchange without prior agreement in writing.

Force Majeure:
The seller shall not be under any liability whatsoever into event of its failure, delay or default in carrying out all or any of its obligations hereunder due in whole or in part to any circumstances or cause beyond its control, including but without prejudice to the generality of the foregoing, fire, flood, power failure, any inability by the seller or its suppliers to obtain any normal commercial terms, materials, labour or facilities, requisite for the manufacture and supply of the goods, strike, lock-out, industrial dispute or action taken by a third party or any other person or firm or company in connection therewith or in consequence of furthermore thereof. BUT this provision shall not in any way limit or restrict the rights of the seller to terminate the contract in accordance with its terms and conditions.

The Machineries:
The seller will endeavour to supply machineries that comply with any expressly agreed specifications and description and with any sample. However such specifications and descriptions are approximate only and minor deviations (including but without prejudice to the generality of the foregoing deviations in colour, markings, measurements and weight) shall not constitute variations from specifications, description or sample.
